Terms of Service & User Agreement
1. Acceptance of Terms
Welcome to Sportopotty, a service of SPORTOPOTTY LLC ("Sportopotty," "we," "our," or "us"). By accessing or using our mobile application, website, or mapping services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not access or use the Platform. These Terms constitute a legally binding agreement between you and SPORTOPOTTY LLC, a limited liability company. Where these Terms refer to "Sportopotty" below, they refer to SPORTOPOTTY LLC.
2. Description of the Platform
Sportopotty is a crowd-sourced, map-based directory and rating platform designed to help sports parents, coaches, players, and spectators locate and evaluate restroom facilities near sports fields and recreational venues. The Platform relies on user-submitted ratings, text updates, reviews, and location data to provide informational content regarding public and semi-public facilities. The Platform also offers optional features including user profiles, saved favorites, team pages and team alerts, community announcements, paid business listings, advertising, and voluntary donations, each described further below.
3. Eligibility and Your Account
You must be at least 13 years old to create an account. If you are under 18, you may use the Platform only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. We do not knowingly collect information from children under 13; if we learn that we have, we will delete the account.
You agree to provide accurate registration information, to keep your password confidential, and to accept responsibility for all activity that occurs under your account. If you sign in using a third-party identity provider (such as Google or Apple), your use of that provider remains subject to that provider's own terms, and you authorize us to receive basic profile information from it for the purpose of creating and accessing your account.
You may change your password or delete your account at any time from your profile page. Deleting your account removes your personal profile information; content you contributed to the map may be retained in anonymized form so that ratings history, team records, and transaction records remain intact. We may suspend or terminate an account that violates these Terms.
4. User-Generated Content & Conduct
Sportopotty allows users to submit text updates, cleanliness ratings, comments, reviews, location pins, team names, and business information and logos ("User Content"). You retain ownership of your User Content, but you grant Sportopotty a worldwide, non-exclusive, royalty-free, sublicensable license to use, host, store, display, reproduce, adapt for display, and distribute such content on and in connection with the Platform, including in emails, social posts, and promotional material about the Platform. You represent that you own or have all rights necessary to submit everything you post, including any image or logo you upload.
You agree not to post, upload, or transmit any User Content that:
- Is defamatory, libelous, harassing, hateful, threatening, or excessively profane;
- Contains false, misleading, or maliciously fabricated information intended to damage the business reputation of any establishment or competitor;
- Identifies or describes any private individual without their consent, or contains nudity or sexual content;
- Discloses the personal information of another person, including a private residential address;
- Violates any applicable local, state, federal, or international law or regulation;
- Infringes upon the intellectual property, privacy, or publicity rights of any third party;
- Contains spam, commercial solicitation, automated bot data, scraped content, or malicious code.
You also agree not to interfere with the Platform's operation, attempt to gain unauthorized access to any account or system, scrape or bulk-download map data, or use automated means to submit ratings or votes.
5. Ratings, Freshness, and Accuracy
Cleanliness scores on the Platform are subjective opinions submitted by members of the public. They are not health inspections, are not verified by any authority, and are not a certification of sanitation. A location's headline score reflects only recent ratings; older ratings age out of the score by design, so a facility's displayed condition may be incomplete, outdated, or simply wrong at the moment you arrive. Bathroom availability, hours, locks, and cleanliness change constantly. Use your own judgment.
6. Location Data and Mapping Services
The Platform uses Google Maps and related mapping services. By using the mapping features you also agree to be bound by the Google Terms of Service and acknowledge the Google Privacy Policy.
If you grant your browser or device permission to share your location, we use it to center the map and to find facilities near you. You can withdraw that permission at any time in your device or browser settings; the Platform remains usable without it. Pins you drop are published publicly, along with the approximate coordinates of the facility — do not drop a pin anywhere you would not want publicly mapped.
No private residences. The Platform maps fields, parks, public facilities, and businesses. Pins on private homes are not permitted and will be removed.
7. Section 230 Notice (Interactive Computer Services)
Sportopotty is an interactive computer service provider under Section 230 of the Communications Decency Act (47 U.S.C. § 230). We do not author, endorse, or guarantee the truthfulness of any User Content posted on the Platform. Third-party users—not Sportopotty—are entirely responsible for the reviews, ratings, and text updates they publish. While we reserve the right to review, moderate, or remove content at our sole discretion, our provision of a moderation mechanism does not make us the publisher of user content.
8. Property Access, Trespassing, and Compliance
Sportopotty maps facilities as reported by community members. Inclusion of a location on our map does not constitute an endorsement, guarantee of public access, or legal authorization to enter private property, restricted areas, employee-only zones, or closed facilities.
User Responsibility: You agree to obey all physical signage, business hours, and staff instructions at any location. You acknowledge that entering private property without permission or ignoring "Customers Only" or "Employees Only" restrictions constitutes trespassing, for which Sportopotty assumes zero liability.
9. Teams
Any registered user may create a team and invite others to join it. If you create a team, you are responsible for the team name and description you choose, for the people you invite, and for any alerts or announcements sent to your team through the Platform. Team names must not impersonate an organization, league, or club you are not authorized to represent, and must not infringe anyone's trademarks. Team pages and the pins shared to them are visible to team members and, where marked, to the public. We may rename or remove a team, or transfer or close it, if it violates these Terms or if the team has no active owner.
10. Business Listings and Paid Placement
Business owners and authorized representatives may claim or create a listing for their establishment. By submitting a business listing you represent that you are authorized to act for that business and that the information you provide — including name, address, hours, contact details, and logo — is accurate and does not infringe any third party's rights.
If you upload a logo, you represent that you own it or are licensed to use it, and you grant us the right to display it on the Platform and to resize or re-encode it for display. Logos must meet the format and size limits shown on the upload form. We may reject or remove a logo that is not the business's own mark, that contains content prohibited by Section 4, or that is unsuitable for display at map scale.
Certain listing features are paid. Paid business listings are billed annually through our payment processor, Stripe, and may be cancelled at any time using the link in the receipt Stripe emails you; cancellation stops future renewals and does not retroactively refund a term already begun unless we say otherwise in writing. Prices and features may change on renewal, with notice.
Paid placement disclosure: Businesses may pay for promoted positions in map results and search listings. Promoted results are marked as such. Payment never changes a facility's cleanliness rating, review text, or score — those come only from users, and we do not sell, alter, or remove ratings in exchange for money.
11. Notice and Takedown Policy for Businesses
If you are a business owner or authorized representative and believe that a review or text update concerning your establishment is factually false, defamatory, or violates these Terms, you may submit a takedown notice through our contact page. We will review reported items promptly and, at our sole discretion, remove content that violates our community standards or factual accuracy guidelines. If you believe content on the Platform infringes your copyright, send us a notice identifying the work, the location of the material, and your contact information, and we will respond consistent with the Digital Millennium Copyright Act.
12. Donations
Donations made through the Platform support hosting, development, and the mobile app. Sportopotty is a for-profit business, not a registered 501(c)(3), and your donation is not a tax-deductible charitable contribution. A donation buys no goods, services, ratings influence, or advertising placement. Donations are processed by Stripe. If you change your mind, contact us within 30 days of your gift and we will refund it — no questions asked.
13. Payments and Processing
All payments — donations and paid business listings alike — are processed by Stripe, Inc. We do not receive or store your full card number. Your use of the payment flow is also subject to Stripe's terms and privacy policy. You are responsible for any taxes that apply to your purchase. Chargebacks initiated without first contacting us may result in the associated listing being suspended.
14. Advertising and Third-Party Services
The Platform displays third-party advertising, including advertising served by Google AdSense, on most public pages. Advertising is not shown on account, payment, or password pages. Third-party advertising partners may use cookies or similar technologies to serve and measure ads; you can manage Google's ad personalization at Google My Ad Center. Advertisements are not endorsements, and Sportopotty is not responsible for the products, services, or content of advertisers or of any third-party site linked from the Platform.
15. Communications and Email
By creating an account you agree to receive transactional email from us — verification, password resets, receipts, team invitations, and notices about your account or these Terms. These are part of the service and are not marketing.
Marketing and community email is separate and optional. You choose at signup whether to receive it, you can change that choice at any time in your profile, and every such email carries an unsubscribe link. Unsubscribing from marketing email does not stop transactional email.
16. Privacy
Information you give us at signup — name, username, email, ZIP code, and any optional details such as phone or favorite sports — is used to operate your account, personalize the map, and send the communications described above. Your username and the content you post are public; your email address, phone number, and password are not shown to other users. We do not sell your personal information. We share data only with the service providers needed to run the Platform (such as Google for maps and advertising, Stripe for payments, and our email delivery provider) and where required by law.
17. Disclaimer of Warranties
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Sportopotty does not warrant that the Platform will be uninterrupted, error-free, secure, or that facility ratings and cleanliness descriptions will match your personal expectations or actual conditions at any given time.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Sportopotty, its founders, members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, data, goodwill, or business reputation—arising out of or in connection with your use of (or inability to use) the Platform, user-generated reviews and ratings, or visits to mapped locations. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Platform will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid us in the twelve months before the claim arose.
19. Indemnification
You agree to indemnify, defend, and hold harmless Sportopotty and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your submission of User Content, or your violation of any laws or third-party rights while using the Platform.
20. Governing Law and Venue
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of laws rules. You and SPORTOPOTTY LLC agree that any dispute arising out of or relating to these Terms or the Platform will be brought exclusively in the state or federal courts located in Connecticut, and you consent to the personal jurisdiction of those courts. Nothing here prevents either party from bringing an individual claim in small claims court.
21. Modifications to Terms
We reserve the right to modify or update these Terms at any time. We will provide notice of significant changes by updating the "Effective Date" and version at the top of this document. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of such changes.
22. Severability and Entire Agreement
If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions stay in full force. Our failure to enforce any provision is not a waiver of it. These Terms are the entire agreement between you and SPORTOPOTTY LLC regarding the Platform and supersede any prior version.
